There is fair use and then there is stealing. Clearly Nick's stolen clip wasn't done for art and fair use. Although I'm not a lawyer.

Being I had not checked off the “fair use” box on this video at the time it was “stolen” I don’t think they legally did anything wrong. They even went as far as posting this in the video description.
