Seller won't budge. He said open case with eBay.
eBay won't open case since I must contact seller?? I called eBay and they said it's too soon, I must wait until tomorrow.

I would suggest you write back to the seller. Instruct him DO NOT SHIP UNDER ANY CIRCUMSTANCES. EBAY AND PAYPAL CASES PENDING.

You can also put up very negative feedback.
Keep it honest.
Keep it harsh.

You can always have ebay remove it once this is settled and you can let him know this.
